Terms of Service.

1. Scope of Service

ApplyTalon provides a browser-based productivity tool designed to assist job seekers in managing professional data and automating form-entry on third-party job portals. Our service includes the browser extension and the associated local data management features.

2. Use License

Subject to these Terms, ApplyTalon grants you a personal, non-exclusive, non-transferable, and revocable license to use the software. This license is strictly for personal, non-commercial use. You may not use ApplyTalon to provide services for others (e.g., as a paid resume-filling service or recruiting agency) without express written consent.

3. Prohibited Conduct & Restrictions

You agree not to, and will not permit others to:

• Reverse Engineer: Copy, modify, create derivative works of, decompile, or reverse engineer any part of the ApplyTalon extension code.
• Malicious Use: Use the tool to spam job portals, bypass security measures in a way that violates the Terms of Service of those portals, or engage in any fraudulent activity.
• Automated Scraping: Use any automated system to scrape data from our website or extension.
• Circumvention: Attempt to bypass subscription gates or alter the Unique Identifier (UID) system to gain unauthorized access to Professional Tier features.

4. Data Sovereignty & User Responsibility

ApplyTalon operates on a local-first model. You acknowledge that:

• You are solely responsible for the accuracy and integrity of the data you input into the extension.
• You are responsible for ensuring that your use of ApplyTalon complies with the Terms of Service of the job portals you visit (e.g., Workday, Greenhouse).
• We do not guarantee employment outcomes or the successful parsing of data on all third-party websites.

5. Intellectual Property

The ApplyTalon name, logo, the "Validation Glow™" technology, and all software code are the exclusive property of ApplyTalon. Nothing in these terms grants you any rights to our trademarks or proprietary branding.

6. Subscriptions and Payments

Access to certain features requires a paid subscription. Payments are processed by third-party providers. We reserve the right to change our subscription triggers or pricing at any time. Subscriptions are tied to the Unique Identifier (UID) of your browser instance; transfer of subscriptions between UIDs is handled at our sole discretion.

7. Indemnity

You agree to indemnify and hold harmless ApplyTalon and its officers from and against any claims, damages, or legal fees arising from your use of the software, your violation of these Terms, or your violation of any third-party rights (including the Terms of Service of job portals).

8. Limitation of Liability

ApplyTalon is provided "as is" without warranty of any kind. To the maximum extent permitted by law, ApplyTalon shall not be liable for any indirect, incidental, or consequential damages (including loss of job opportunities or data breaches occurring on your local device) resulting from your use of the tool.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
